OVERVIEW
Welcome to Hurdz Hemp. Throughout these Terms of Service, the terms "Hurdz Hemp," "we," "our," and "us" refer to Hurdz Hemp and its owners, employees, affiliates, successors, and assigns.
These Terms of Service govern your access to and use of our website, products, services, online store, and any related content, features, or functionality (collectively, the "Services").
By accessing our website, browsing our content, creating an account, requesting a quote, placing an order, or purchasing any product from Hurdz Hemp, you agree to be bound by these Terms of Service, our Privacy Policy, Refund Policy, Shipping Policy, and any additional policies referenced herein.
If you do not agree to these Terms, you should not access or use our Services.
SECTION 1 – ELIGIBILITY & ACCOUNT RESPONSIBILITIES
By using this website or purchasing our products, you represent and warrant that:
- You are at least eighteen (18) years of age or the age of majority in your jurisdiction.
- You have the legal authority to enter into binding agreements.
- Any information you provide is accurate, complete, and current.
- You are authorized to use the payment method submitted.
If you create an account, you are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account.
Hurdz Hemp reserves the right to suspend or terminate any account that contains inaccurate information, fraudulent activity, misuse of the website, or violations of these Terms.
SECTION 2 – PRODUCTS
Hurdz Hemp manufactures and distributes premium hemp bedding and related agricultural products for use with horses, livestock, poultry, companion animals, and other approved applications.
Because hemp is a natural agricultural product, slight variations in color, texture, particle size, moisture content, dust levels, aroma, and appearance may occur from batch to batch and shall not be considered defects.
Product photographs, descriptions, dimensions, weights, and specifications are provided for general informational purposes only and may vary slightly from the product received.
We reserve the right to improve, modify, discontinue, or change products, specifications, packaging, manufacturing locations, suppliers, or formulations without prior notice.
Nothing contained on this website shall be interpreted as guaranteeing identical performance under every management system or environmental condition.
SECTION 3 – ORDERS
Submission of an order constitutes an offer to purchase products from Hurdz Hemp.
Orders are not accepted until payment has been authorized (when applicable) and Hurdz Hemp confirms acceptance.
We reserve the right to refuse, cancel, or limit any order for any reason, including but not limited to:
- inventory availability;
- pricing errors;
- suspected fraud;
- shipping restrictions;
- inaccurate customer information;
- commercial risk assessment.
Prices are subject to change without notice prior to order acceptance.
Once an order has been accepted and entered into production or prepared for shipment, cancellations may not be possible.
SECTION 4 – COMMERCIAL SALES
Commercial, wholesale, pallet, half-truckload, truckload, distributor, dealer, and reseller purchases are considered commercial transactions.
Commercial customers acknowledge that:
- hemp bedding is a natural agricultural product;
- bedding performance varies depending upon stall management practices;
- performance is affected by bedding depth, ventilation, moisture levels, animal behavior, cleaning practices, flooring, environmental conditions, and numerous other variables outside the control of Hurdz Hemp.
Commercial customers agree to inspect products promptly upon delivery.
Claims regarding shortages, visible damage, or suspected manufacturing defects should be reported as soon as reasonably possible after discovery.
Commercial customers agree to provide Hurdz Hemp with a reasonable opportunity to investigate any alleged defect before requesting refunds, initiating chargebacks, filing legal claims, or disposing of the product.
Hurdz Hemp reserves the right to request:
- photographs;
- videos;
- product samples;
- batch or lot numbers;
- moisture testing;
- on-site inspections;
- additional information reasonably necessary to evaluate the claim.
Failure to preserve the product or provide a reasonable opportunity for inspection may affect Hurdz Hemp's ability to evaluate the claim.
SECTION 5 – SHIPPING & DELIVERY
Shipping dates and delivery estimates are provided in good faith but are estimates only.
Hurdz Hemp is not responsible for delays caused by:
- freight carriers;
- weather;
- customs;
- labor disruptions;
- acts of God;
- manufacturer delays;
- transportation shortages;
- government actions;
- events beyond our reasonable control.
Risk of loss transfers to the purchaser upon delivery by the carrier unless otherwise agreed in writing.
Customers are responsible for inspecting shipments immediately upon delivery.
Visible freight damage should be documented with the carrier at the time of delivery whenever possible.
Shortages or shipping damage should be reported to Hurdz Hemp promptly, preferably within forty-eight (48) hours of delivery.
SECTION 6 – PRICING, PAYMENT & BILLING
All prices displayed by Hurdz Hemp are subject to change without prior notice. The price applicable to your purchase is the price confirmed at the time your order is accepted.
Unless otherwise stated, prices do not include applicable sales tax, freight, shipping charges, fuel surcharges, customs duties, import fees, or other governmental charges, all of which are the responsibility of the purchaser.
Payment in full may be required prior to shipment unless other payment arrangements have been approved in writing.
By submitting payment information, you represent and warrant that:
- You are authorized to use the payment method provided.
- The payment information is accurate and complete.
- You authorize Hurdz Hemp to charge the full amount of your purchase, including applicable taxes, freight, shipping charges, and any additional agreed-upon fees.
Failure to make payment when due may result in delayed shipment, cancellation of the order, additional collection costs, or other remedies permitted by law.
SECTION 7 – RETURNS, REFUNDS & EXCHANGES
Customer satisfaction is extremely important to Hurdz Hemp, and we stand behind the quality of our products.
Due to the nature of animal bedding products, opened, used, or installed products cannot be returned for resale.
Retail purchases of unopened products may be eligible for return in accordance with our Refund Policy.
Commercial, wholesale, pallet, half-truckload, and truckload purchases are generally considered final upon delivery, subject to Hurdz Hemp's investigation of any timely reported manufacturing defect.
If a customer believes a product contains a manufacturing defect, Hurdz Hemp must be provided a reasonable opportunity to investigate the claim before any refund, replacement, or other remedy is determined.
If Hurdz Hemp determines that a manufacturing defect exists, Hurdz Hemp may, at its sole discretion:
- Replace the affected product;
- Refund the purchase price of the affected product;
- Provide replacement product from another production lot;
- Offer another mutually agreeable resolution.
No refund shall be issued solely because a customer is dissatisfied with product performance where such performance may reasonably be affected by management practices, installation methods, environmental conditions, or other factors outside Hurdz Hemp's control.
SECTION 8 – PRODUCT CLAIMS & INSPECTIONS
Any customer alleging that a product is defective shall notify Hurdz Hemp promptly after discovering the issue.
Customers agree not to dispose of, destroy, materially alter, or replace the product until Hurdz Hemp has been provided a reasonable opportunity to inspect the product or otherwise authorizes its disposal.
As part of any investigation, Hurdz Hemp may request:
- photographs;
- videos;
- product samples;
- batch or lot numbers;
- moisture testing;
- shipping information;
- storage information;
- installation details;
- maintenance procedures;
- access to inspect the product in person.
Customers agree to cooperate in good faith throughout the investigation.
Failure to preserve the product or provide a reasonable opportunity for inspection may limit Hurdz Hemp's ability to determine the cause of the issue and may affect the remedies available.
SECTION 9 – DISPUTES, CHARGEBACKS & GOOD FAITH RESOLUTION
Hurdz Hemp is committed to resolving customer concerns promptly, professionally, and fairly.
Customers experiencing concerns with any product are encouraged to contact Hurdz Hemp immediately so that we may investigate the matter and work toward an appropriate resolution.
Before initiating a chargeback, payment dispute, lawsuit, arbitration, or other legal proceeding relating to an alleged product defect, customers agree to provide Hurdz Hemp with a reasonable opportunity to investigate the concern and attempt to resolve the matter in good faith.
Initiating a chargeback without first providing Hurdz Hemp with a reasonable opportunity to investigate may be considered a breach of these Terms to the extent permitted by applicable law.
Nothing contained in this section limits any rights that cannot legally be waived under applicable law.
SECTION 10 – PRODUCT PERFORMANCE
Hurdz Hemp products are manufactured to high quality standards using premium hemp fiber and hurd.
Because hemp bedding is a natural agricultural product, Hurdz Hemp cannot guarantee identical performance in every barn, stable, coop, kennel, farm, or facility.
No two barns, facilities, management practices, or environmental conditions are identical, and product performance may reasonably vary from one operation to another.
Product performance may vary based upon factors including, but not limited to:
• bedding depth;
• stall construction;
• flooring systems;
• rubber mats;
• ventilation;
• humidity;
• cleaning schedules;
• manure removal practices;
• urine management;
• animal species;
• animal health;
• stocking density;
• environmental conditions;
• storage conditions after delivery;
• other factors beyond Hurdz Hemp's reasonable control.
Variations in product performance resulting from these factors shall not, by themselves, constitute evidence of a manufacturing defect.
SECTION 11 – NO WARRANTY OF FITNESS FOR A PARTICULAR USE
Hurdz Hemp warrants that its products are manufactured in accordance with its quality standards. Except as expressly stated in these Terms or where prohibited by applicable law, Hurdz Hemp makes no guarantee that its products will be suitable for every customer's specific application, management practice, facility, or intended use.
Customers are responsible for determining whether Hurdz Hemp products are appropriate for their individual operation, facility, animals, and management practices.
SECTION 12 – STORAGE OF PRODUCTS
Improper storage after delivery may adversely affect product quality and performance.
Hurdz Hemp shall not be responsible for damage, deterioration, moisture intrusion, mold, odor, contamination, or diminished product performance resulting from improper storage or handling after delivery.
SECTION 13 – FORCE MAJEURE
Hurdz Hemp shall not be liable for any delay or failure to perform resulting from events beyond its reasonable control, including but not limited to severe weather, natural disasters, fire, flood, labor disputes, transportation interruptions, supply chain shortages, governmental actions, pandemics, equipment failures, carrier delays, or other unforeseen events.
Performance shall be suspended for the duration of such event, and Hurdz Hemp shall resume performance as soon as reasonably practicable.
